Watson Murder Conviction Upheld In Second Trial After Defendant Convicted On Only Gross Vehicular Manslaughter In First Trial

California’s Fourth District Court of Appeal, Division One, just affirmed the second degree murder conviction of Adam Barooshian.  People v. Barooshian (2024) __Cal.App.5th___ (Docket No. D081050). Barooshian was a Marine with a prior DUI conviction who drove the wrong way on a freeway with a high blood-alcohol content and killed a motorcyclist.       Along with other vehicle code offenses, Barooshian was charged with murder [Penal Code § 187, subd. (a)] under the Watson murder theory and vehicular manslaughter with gross negligence while intoxicated [Vehicle Code § 191.5, subd. (a)].  The California Supreme Court held in People v. Watson (1981) 30 Cal.3d 290 that one who kills another while driving under the influence may be charged with second degree murder where the circumstances support a finding of implied malice.      The

Alcohol Now Banned in Tennessee Wildlife Management Areas

Due to alleged high Number of incidents of driving under the influence (DUI/DWI) and frequent crashes in the Tennessee Wildlife Management Areas, the Tennessee Wildlife Resource Agency (TWRA) have issued a ban of alcohol in most of the areas managed by the TWRA. As reported by WJHL-TV, starting April 15, 2024, possessing and consuming alcohol in TWRA Wildlife Management Areas (WMA) will become illegal, with a few exceptions to the rule. The WJHL-TV report shared that, “alcohol will still be permitted at designated TWRA campgrounds and on public waters bordering or within a WMA. Drunken disorderly conduct will still be prohibited on WMAs, including in those designated areas. DUI Can Effect You Outside of the Legal System

This weekend, former Florida Gator and now Georgia Bulldog, Trevor Etienne, the younger brother of NFL superstar Travis Etienne, was arrested for DUI. Like the rest of us, Trevor is facing consequences outside of the legal arena for his actions.
